Terms & Condition

This agreement between FidaHost (PROVIDER) and you (CLIENT). You, the client, should familiarize yourself with this document. Any usage of our services constitutes an agreement to the terms and conditions set forth herein. You the client are expected to know and obey all applicable local, state and federal laws while using FidaHost services.

1.Content

FidaHost wishes to provide reliable and fast web hosting for anyone with the need for such a service. In using FidaHost clients accept the following restrictions:

* Hacking, which includes, for example penetrating or attempting to access, without authorization, another computer or network. Port scans, stealth scans, and fraudulent credit card "phishing" techniques are also prohibited.
* Hosting of files or other data that infringes on another's copyright or other intellectual property rights.
* Spamming, or sending of bulk unsolicited email. We maintain a strict policy on spamming, which includes the sending of unauthorized commercial messages by use of our services, or by maintaining an open SMTP connection. We reserve the right to refuse or terminate service based on reasonable indications that you are engaged in spamming of any sort.
* Uploading or linking to any content that violates another's right of publicity or privacy.
* Distributing hate speech, or any other content that is obscene, abusing, which could be considered libelous and defamatory.
* Hosting, storing, or distributing child pornography. If any such content is found and brought to our attention, the proper law enforcement agencies will be notified.
* Hosting large amounts of data not specifically tied ("linked") to your hosting account. FidaHost encourages users looking for file storage/backup solutions to seek other services that specialize in this.

Examples of unacceptable material on our services
* IRC Scripts/Bots
* Proxy Scripts/Anonymizers
* Pirated Software/Warez
* Image Hosting Scripts (similar to Photobucket or Tinypic)
* IP Scanners
* Bruteforce Programs/Scripts/Applications
* Mail Bombers/Spam Scripts
* File Dump/Mirror Scripts (similar to rapidshare)
* Commercial Audio Streaming (more than one or two streams)
* Escrow/Bank Debentures
* High-Yield Interest Programs (HYIP) or Related Sites
* Sale of any controlled substance without prior proof of appropriate permit(s)
* Prime Banks Programs
* Lottery Sites
* Hateful/Racist/Harassment oriented sites
* Hacker focused sites/archives/programs
* Sites promoting illegal activities
* Forums and/or websites that distribute or link to warez/pirated/illegal content
* Bank Debentures/Bank Debenture Trading Programs
* Mailer Pro

2.Extremely High Usage

Our clients may not:
*Use 30% or more of system resources for longer than 180 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
*Run any gaming servers such as counter-strike, half-life, battlefield1942, etc...
*Run cron entries with intervals of less than 15 minutes.

3.Bandwidith Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

4.Backup Limit

FidaHost will not make backup for accounts who spend more than 15GB.

5.Money Back Guarantee

You may cancel your account anytime within the first 30 days for any reason or of no reason at all and receive a full 100% refund of your hosting fees.

We do not provide refund for the :
*Domain name registration fees
*Sites deemed to be in violation of our Terms of Service Agreement
*Sites hosting illegal or copyrighted material
*Sites being used for credit card phishing, or consumer financial schemes
*Sites or e-mail services being used for mass advertising or 'SPAM' purposes.
*Any other site deemed to be malicious or fraudulent in nature
*And for all services who was payed for one month

6.Email Abuse

FidaHost has a zero tolerance policy on email abuse. Any attempt to use our system to propagate and/or return SPAM or U.C.E. is expressly prohibited. Any mass mailing that either is sent using a FidaHost address or which references a domain hosted on the FidaHost system have their account suspended and/or terminated at FidaHost's discretion.

7.Background Running Programs

FidaHost not allow background-running programs. This includes any IRC related software such as bouncers and bots. In certain cases we may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

8.Personal Information

When you place an order for our services, your personal information, including your credit card information, is transmitted via the use of Secure Socket Layer technology, the industry standard for encrypting sensitive information. We take your privacy very seriously, and as such, will not sell your personal information to third party, and will take reasonable steps to keep it from being disclosed to any third party. You consent to be called by a representative of www.FidaHost.com at the telephone number above and/or emailed important information about Just Host products and services.

9.Responsibility for Content

You, as the FidaHost Web Services customer, are solely responsible for the content stored on and served by your FidaHost Web Services web site.

10.Changes to the TOS

FidaHost reserves the right to revise its policies at any time without notice.

*Any site found to be violating our TOS may be terminated without notice and without refund.
